This website is operated by Evolution Equestrian Co. (“Evolution Equestrian,” “we,” “us,” “our”). By accessing our site or purchasing from us, you agree to these Terms & Conditions (“Terms”) and to any policies referenced here (including Shipping, Refunds & Returns, and Privacy). If you do not agree, please do not use the site.

We may update these Terms at any time by posting a revised version. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.

Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling our online sales.

2) Online Store Terms & Acceptable Use

  • You must be the age of majority in your province/territory to place an order.

  • Do not use our site for unlawful purposes, infringe IP rights, or introduce malware. We may suspend or refuse service for abusive, fraudulent, or unlawful activity.

  • You agree not to reproduce, resell, or exploit the Service without our written permission.


3) Pricing, Currency, Taxes & Promotions

  • All prices are in Canadian dollars (CAD) and are subject to change without notice.

  • Applicable GST/HST and PST are calculated at checkout based on your shipping address.

  • We aim for accuracy but may correct errors (price, availability, description) before or after you place an order. If we cancel, we’ll refund you in full.

4) Product Information & Availability

We make every effort to display colours and details accurately; device settings may vary. Quantities may be limited. We may discontinue products or restrict orders at our discretion.


5) Orders, Payment, and Verification

We reserve the right to refuse/cancel any order (e.g., suspected fraud, inventory errors, restricted destinations). If we change or cancel an order, we will attempt to notify you using the contact details provided at checkout. You agree to provide current, complete, and accurate purchase and account information.


6) Shipping, Delivery & Risk of Loss

Shipping, timelines, carriers, fees, and free-shipping thresholds are described in our Shipping Policy (incorporated here). Title and risk of loss pass to you upon delivery by the carrier to the address you provide. If items are returned to us as undeliverable due to an incorrect address or failure to pick up, we’ll contact you to arrange re-shipment (additional postage may apply).

Distance-Sales (BC) disclosure: We provide delivery arrangements and estimated supply dates at checkout/order confirmation. If goods/services are not supplied within 30 days of the supply date, BC consumers may have statutory cancellation and refund rights under the Business Practices and Consumer Protection Act. If a contract copy/required info was not provided or is non-compliant, additional cancellation rights may apply. We honour all such rights as required by law. BC Laws+1


7) Returns, Refunds & Exchanges

Our Refunds & Returns Policy (incorporated here) explains eligibility, steps to start a return, non-returnable items, shipping cost treatment, and timelines. Nothing in our policy limits your statutory rights (e.g., BC distance-sales cancellation/refund timelines) and we process eligible statutory refunds within 15 days of your cancellation notice as required. 8) Consignment, Used Goods & Safety-Critical Items

  • Consignment items are sold as-is and are final sale (subject to non-excludable statutory rights).

  • For safety-critical equipment (e.g., helmets, protective gear), carefully follow manufacturer fit and replacement guidance. We do not provide veterinary or medical advice.


9) Gift Cards / Store Credit (Prepaid Purchase Cards)

  • Unless an exception in BC law applies, gift cards/store credit do not expire and cannot carry fees, other than limited permitted fees (e.g., personalization or replacement). We disclose applicable terms and remaining balance information on request. BC Laws+2Consumer Protection BC+2


10) Communications & Marketing (CASL)

With your consent, we may send you emails or messages about products, promotions, and updates. You can withdraw consent at any time via the unsubscribe link in our emails. We collect, use, and disclose personal information as described in our Privacy Policy and in accordance with BC’s Personal Information Protection Act (PIPA). 13) Intellectual Property

All content on this site (text, graphics, logos, images) is owned by or licensed to Evolution Equestrian and protected by applicable IP laws. You may not use our trademarks or content without prior written consent.


14) Warranties, Statutory Rights & Limitation of Liability

Except as expressly stated, the site and products are provided “as is”. Nothing in these Terms limits your non-excludable rights under BC law, including implied conditions under the Sale of Goods Act (e.g., goods reasonably durable and fit for their ordinary purpose) and rights under the Business Practices and Consumer Protection Act. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from use of our site or products. BC Laws


15) Governing Law & Dispute Resolution

These Terms are governed by the laws of British Columbia and Canada. Where permitted by law, disputes shall be brought in the courts of British Columbia.
